"According to buyer surveys by manufacturers, 68% of owners of all-terrain vehicles, or ATVs, ride on private land." Do you? For me, it's nearly every ride lately, but normally we have permission. We make a determined effort to not tear up anything and leave a small trail. People lately have been cracking down on it though. I had the misfortune of driving around (not on my 4wheeler) and seeing 4 of my friends coming out of a private trail, stopped by the owner, accompanied by police. This was harassment, because although we pretty much knew it was private property, nothing was posted. No paint, no signs, open gate.

Why do you consider that harrassment? Your friends were tresspassing.
You should always know where and who's land you are on, at all times. Hunting, fishing, ATVing, etc. The property owner might not can technically prosecute you for tresspassing since the land was not posted, but you are not being a very good neighbor by going on another's land without permission.

It was harassment becauase the land was NOT marked whatsoever. No paint, no signs, nothing. We had rode there for years. We had always thought it was the neighborhood's, public land waiting for maybe development, which is where we ride a lot. We never had any trouble on it, either, and I had a friend given permission for us to ride and cut through to the rest of the trails. There is nothing on this property, really, so all we do is cut through.

I ride on my own private land alot and it is well marked and we still fet alot of yahoos but mostly during hunting season.
I dont know about all states but in Idaho if is cultavated and or fenced it is already considered posted and private.
With the numbers of riders on public ground around me it is a fricking circus to go on public ground so I prefer if I can to ride on private ground and just be alone as much as possible.

Back in 1992 when I got my first ATV I had the whole area to myself and no one cared about where I went but now things have changed and there are lots of atvs. There is some real good riding in my area on private land that I am getting pemission to ride so hopefully I have myself setup for awhile.
